Judicial Jihad
The U.S. Court of International Trade, an obscure court 99.99% of Americans have never heard of, just joined the judicial jihad against President Trump and his MAGA agenda.
Yesterday evening, the trade court struck down the president’s broad tariff policy as an overreach of executive authority. The court did not say that the president has no authority to impose tariffs. Specific tariffs on steel, aluminum, lumber, and semiconductors are not impacted by this decision.
But the court ruled that the president cannot use emergency powers to enact a broad tariff policy, such as the president’s 10% baseline global tariffs. This ruling severely limits the president’s ability to use tariffs as a tool of economic policy, foreign policy, and national security policy.
It definitely complicates his ability to renegotiate bad trade deals and force other nations to abandon their unfair trade practices.
The Trump administration immediately appealed the decision, and the White House issued the following statement:
“Foreign countries’ nonreciprocal treatment of the United States has fueled America’s historic and persistent trade deficits. These deficits have created a national emergency that has decimated American communities, left our workers behind, and weakened our defense industrial base. . .
“It is not for unelected judges to decide how to properly address a national emergency. President Trump pledged to put America First, and the Administration is committed to using every lever of executive power to address this crisis and restore American Greatness.”
The people cheering this decision and other court rulings as “protecting democracy” have it backwards. These decisions are thwarting democracy by thwarting the clear will of the American people.
These decisions were not issued with the same ferocity and velocity when Obama and Biden were pushing the limits of executive authority. So, you know something else is going on.
The Left, as it has done for decades, is using unelected judges to block conservative policies and force its agenda on the American people.
THIS JUST IN: A federal appeals court has temporarily blocked the international trade court’s ruling, reinstating the president’s 10% baseline tariffs for now.
